1. Introduction & Acceptance

These Terms and Conditions ("Terms") govern your use of OpenClaw, an SMS-based personal AI assistant operated by Perfectly Human LLC, a Washington State limited liability company ("Perfectly Human", "we", "us"). By using the Service, you agree to be bound by these Terms.

2. SMS Messaging Service

Program description. OpenClaw is a personal AI assistant accessed via SMS, operated by Perfectly Human LLC. You text a designated number; the Service responds with AI-generated replies based on your message and conversation history.

Message frequency. Variable, in response to user-initiated messages. The Service does not send unsolicited messages.

Cost.Msg & data rates may apply. Standard messaging and data rates from your mobile carrier apply to all messages sent to and received from the Service.

Carriers. Carriers are not liable for delayed or undelivered messages.

Opt-in.You opt in to the Service when you (a) complete account registration with Perfectly Human LLC, or (b) send your first message to the Service's designated number after being granted access.

HELP. Text HELP to the Service to receive a response containing program information and the support contact email.

STOP. Text STOP to the Service at any time to immediately opt out. You will receive a single confirmation message and then no further messages from the Service. To resume the Service after opting out, contact riley@perfectlyhuman.ai.

3. Acceptable Use

You agree not to use the Service to:

• Send unlawful, harassing, or abusive content.
• Attempt to disrupt, reverse-engineer, or otherwise compromise the Service.
• Impersonate another person.
• Send messages on behalf of any other person without authorization.

We may suspend or terminate your access to the Service at our discretion if you violate these Terms.

4. Intellectual Property

Perfectly Human LLC retains all rights, title, and interest in the Service, including all software, AI models, prompts, and design. You retain ownership of the content of messages you send. By sending messages to the Service, you grant Perfectly Human a limited license to process those messages for the purpose of operating the Service.

5. Service Availability & Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee uninterrupted availability, accuracy of AI responses, or fitness for any particular purpose. AI-generated responses may contain errors or unexpected content.

6. Limitation of Liability

To the maximum extent permitted by law, Perfectly Human LLC shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service. Our total aggregate liability for any claim arising from these Terms or the Service shall not exceed one hundred dollars ($100) USD.

7. Changes to Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Material changes will be communicated to active users via SMS. Continued use of the Service after a change constitutes acceptance of the updated Terms.

8. Governing Law

These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in King County, Washington, and you consent to the personal jurisdiction of such courts.
